Terms of Service

SmarterAppointer is software that lets businesses ("Businesses") publish a booking page, take appointments, send WhatsApp confirmations and reminders, optionally make automated reminder calls, manage bookings from a dashboard or WhatsApp, and collect payments through Razorpay.

We are a software provider only. We are not a clinic, salon, healthcare provider or agent of any Business. Each Business alone is responsible for its services, prices, staff, advice, quality and conduct. We do not give medical advice.

• You must be 18 or older and give true, current information.
• Keep your password and linked WhatsApp number secure. Actions taken from your account or linked number are treated as yours.
• Tell us at once at hello@smarterappointer.com if you suspect misuse.

• You are responsible for the bookings, prices and information on your page, and for honouring confirmed bookings.
• You are the Data Fiduciary for your Customers' data. You must have a lawful reason to collect it, collect only what you need (only ask for health details if necessary), and handle their requests about their data. We process it for you as described in our Privacy Policy.
• WhatsApp and calls sent through the platform must be about the Customer's booking. No promotional or bulk messaging.
• Refunds for your services are your responsibility (see our Cancellation & Refund Policy).
• You must follow all laws that apply to your business, including healthcare, consumer and tax laws.

• Your booking is a contract between you and the Business, not with us.
• Give a correct phone number. You agree to receive WhatsApp messages, and automated calls if the Business uses them, about your booking. Reply STOP to stop WhatsApp messages.
• Cancellations, rescheduling and refunds follow the Business's policy.

• The Free plan includes 50 unlocked bookings every calendar month (India time). The count resets on the 1st of each month. Bookings above that limit are still received but stay locked (customer details hidden) until you upgrade; locked bookings do not unlock when the month changes.
• Paid plan prices are shown on our Pricing page and are charged in advance, plus GST where applicable.
• We may change prices with at least 30 days' notice. Changes apply from your next billing cycle.

Online payments are processed by Razorpay under its own terms. We do not store card or bank details. A payment is confirmed only after Razorpay confirms it to us.

You must not:

• break any law, or use the service for fraud, spam, harassment or illegal services;
• upload false bookings, or another person's data without permission;
• try to access other accounts or data, test our security without written permission, or overload the service;
• copy, resell or reverse engineer the service.

We may suspend or close accounts that break these rules, with notice where reasonable.

We work to keep the service running but do not promise it will always be available or error-free. WhatsApp, call and payment delivery depends on third parties (Meta, Twilio, Razorpay, telecom networks) and may fail or be delayed. Do not rely only on SmarterAppointer for urgent or emergency communication.

• We are not liable for a Business's services, or for disputes between a Business and its Customers.
• We are not liable for indirect losses such as lost profit, lost business or lost data.
• Our total liability to a Business for any claim is limited to the fees it paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.

Businesses will compensate us for claims, fines and costs caused by their services, their content, their misuse of the platform or their breach of law or of these terms.

You can stop using the service and ask us to close your account at any time. We may end or suspend access for breach of these terms or if required by law. After closure we handle data as described in the Privacy Policy.

These terms are governed by the laws of India. Courts at Narmadapuram, Madhya Pradesh have exclusive jurisdiction. Please contact us first — most issues can be solved quickly.

We may update these terms. The date at the top shows the latest version. Using the service after a change means you accept it. For important changes we will inform account holders in advance.
